Rivne: Analyzing discipline of local deputies

The Civil Network OPORA researched discipline of deputies and executive committee of Rivne city council. During the monitoring was analyzed attendance of plenary meetings, standing committees of deputies and meetings of executive committee of Rivne city council of the 6th convocation.

13 sessions of Rivne city council of 6th convocation were held before 1 February 2012. The first session was held in 2010, thirteen’s – in 2012. In 2012 were held 11 sessions of city council with 19 plenary meetings. This research considers the attendance of deputies on plenary sessions and meetings of standing committees in 2011. It doesn’t include 1 and 13 sessions of Rivne city council of the 6th convocation.

ATTENDANCE AT PLENARY SESSIONS

According to the analysis of Rivne city council of 6th convocation, the most disciplined faction with 94,7% attendance is “United Center”. The least disciplined, with 63% is a party “UDAR”.

Parties with little number of deputies are the most disciplined. Therefore, two most disciplined factions “United Center” and “Front of Changes” consist of one and two deputies respectively. The biggest faction in city council All-Ukrainian Union “Fatherland” consists of 21 deputy and is on 6th place by the level of attendance. All-Ukrainian Union “Freedom” and the Party of Regions, which are on second and third place by the number of deputy mandates, have the lowest level of attendance. Therefore, VO “Svoboda” with 79% of attendance is on 7th place from 9 factions, and the Party of Regions – on 8.

The most plenary sessions – 12 out of 19 missed Volodymyr Valiavka form VO “Svoboda”. In 2011 the deputy missed 67% plenary sessions. Oleksii Hubanov, head of the faction the Party of Regions in Rivne council, missed 9 out of 19 plenary sessions, what is 47% of the total amount. On the third place by missed sessions is deputy from All-Ukrainian Union “Fatherland” Oleksandr Babat. He was absent on 8 plenary sessions, what is 42% out of a total number. Another 7 deputies missed 7 sessions. They are representatives of:

All-Ukrainian Union “Fatherland” – Andrii Borovyk, Viacheslav Malashynskyi, Antonina Ozimkovska:
“The Party of Regions” – Myroslav Bertash, Volodymyr Kovalenko;
“UDAR” – Viktor Vivsiannyk;
“Strong Ukraine” – Vasyl Vlasenko.

On 6 sessions, what is 31,6% out of their total amount, were absent representatives of VO “Svoboda” Andrii Ostapchuk and a deputy from the Party of Regions Olha Smoliarchuk. OPORA discovered that Olha Smoliarchuk missed most of plenary sessions due to illness. Volodymyr Zyl form all-Ukrainian Union “Fatherland”, Stanislav Riazanov and Anatolii Bobrovskyi from VO “Svoboda” missed 5 sessions every of them, what is 26,3% out of the total amount of plenary sessions in 2011.

They are: Larysa Zelinska, Nina Kimstach from all-Ukrainian Union “Fatherland”, Oleh Karpiak, Oleksandr Lashchuk from VO “Svoboda”, Taras Maksymenko, Vasyl Kharkovets, Sviatoslav Yevtushenko – unaffiliated. We remind, that Taras Maksymenko and Vasyl Kharkovets left faction “Front of Changes” in September 2011, and in July Sviatoslav Yevtushenko was expelled from “UDAR”.

4 sessions missed - Valentyn Demchuk, Yurii Zaporozhets, Vitalii Pershohuba, Serhii Sydoryshyn from all-Ukrainian Union “Fatherland”, Yurii Romanenko from all-Ukrainian Patriotic Union. 3 sessions missed - Iryna Vynohradova form all-Ukrainian Union “Fatherland”, Liudmyla Turovska from the People’s Party, Ruslan Shevchuk from all-Ukrainian Patriotic Union and Artur Khorkholiuk from Our Ukraine.

ATTENDANCE AT MEETINGS OF STANDING COMMITTEES

Standing committees are bodies of local councils which are chosen from deputies for examination, preliminary consideration and preparation of issues that lie within their jurisdiction, controlling implementation of decisions of council and its executive bodies. In Rivne council of 6th convocation were created 9 standing committees.

In 2011, were held 17 meetings of the Standing Committee on Law, Justice and Human Rights. The committee consists of 4 deputies. Only a head of committee, from VO “Svoboda”, was present an all sessions. Mykhailo Zharovskyi (the Party of Regions) and Mykola Radko (all-Ukrainian Union “Fatherland”) missed one session. Another representative of all-Ukrainian Union “Fatherland” Stanislav Riazanov missed 3 sessions, what is 17,65% of all.

A Standing Committee on Regulations, deputies’ activity and ethics, local government development gathered 15 times in 2011. A head of the Commission Oleksandr Chubai (“All-Ukrainian Patriotic Union”) and Liubomyr Hladun (All-Ukrainian Union “Fatherland”) were present at all meetings. Another deputy from All-Ukrainian Union “Fatherland” Andrii Borovyk missed 5 meetings, what is 33,3% of the total amount. Head of the Department of Construction and Architecture of Rivne Regional State Administration Yurii Sidletskyi, form the Party of Regions, is a leader in missing the meetings. He was absent on 12 meetings, what is 80% of the total amount in 2011 (Table 3).

In proceedings of meetings of a standing committee missed by Yurii Sidletskyi states that his absence was due to work issues. Thus, as a result of working as a deputy and in executive body at the same time, Yurii Sidletskyi missed almost all meetings of standing committee.

There were 24 meetings of Standing Committee on Health Care, Maternity and Child Health and Social Welfare last year. The committee consists of 4 deputies. This committee is perfect example in terms of attendance. Larysa Zelinska, Iryna Vynohradova (both - all-Ukrainian Union “Fatherland”) and Olha Smoliarchuk (the Party of Regions) missed only two meetings (8,33%). The deputy from all-Ukrainian Union “Fatherland” Iryna Vynohradova missed 4 meetings, what is 15,38% of the total number in 2011.

Standing Committee on Science, Education, Culture, spiritual revival, youth, sports, relations with public associations and mass media held 28 meetings in 2011. The committee consists of 5 deputies. Oleksandr Sachuk, a member of “Our Ukraine” was present on all meetings. A head of the Committee Svitlana Bohatyrchuk-Kryvko (the People’s party) missed 1 meeting (3,57% of the total amount). Oleksandr Kursyk (all-Ukrainian Union “Fatherland”) – 14,3%, Oleksandr Nesteruk (all-Ukrainian Union “Fatherland”) – 21,43%. Oleksii Hubanov, deputy head of Rivne Regional State administrations and head of the faction the Party of Regions missed most of th meetings.

The same as Yurii Sidletskyi, Oleksii Hubanov combines working as a deputy and in executive body.

Standing Committee on Economic, Investment, Industrial Development and Entrepreneurship Support gathered 30 times in the last year. The committee consists of 5 deputies. The read of Standing Committee, Yurii Vozniuk form “Front of Changes” was absent on 1 meeting of the Committee. Volodymyr Zyl (all-Ukrainian Union “Fatherland”) missed 20% of meetings, Marian Hoda (“Our Ukraine”) and Serhii Sydoryshyn (all-Ukrainian Union “Fatherland”) – 26, 7% of meetings. The biggest amount of meetings missed a deputy from VO "Svoboda" and private entrepreneur Volodymyr Valiavka, which was absent on 90% of meetings.

In 2011, were held 38 meetings of the Standing Committee on Budget, Finance and communal property management. The committee consists of 9 deputies. Eduard Halaichuk from all-Ukrainian Union “Fatherland” missed only 1 meeting, what is 2,63% of the total amount. Oleh Karpiak (“VO Svoboda”) was absent on 7,89% of meetings, Vasyl Kharkovets (unaffiliated) – 13,16%, Serhii Vasylchuk (“Our Ukraine”) – 15,79%, Serhii Paladiichuk (“United Center”) – 23, 68%, Vitalii Pershohuba (all-Ukrainian Union “Fatherland”) – 31,58%, Yurii Zaporozhets (all-Ukrainian Union “Fatherland”) – 34,21%. Exactly 50% of meetings missed member of the "Strong Ukraine" Serhii Vlasenko.

A Standing Committee on architecture, building and land distribution held 51 meeting in 2011. The committee consists of 11 deputies. Anatolii Chuhuievets was absent only on one meeting. Liudmyla Turovska (“The People’s Party") missed 7,12%, Myroslav Bertash (the Party of Regions) – 10,94%, Anton Sachuk (“Front of Changes”) – 15, 45%, Oleksii Khmyletskyi (“Our Ukraine”) – 16,67%, Volodymyr Hrudnytskyi (all-Ukrainian Union “Fatherland”) – 22,40%, Ruslan Shevchuk (“All-Ukrainian Patriotic Union”) – 20,83%, Antonina Ozimovska (all-Ukrainian Union “Fatherland”) – 29,28%, Nina Kimstach (all-Ukrainian Union “Fatherland”) – 33,33%, Andrii Ostapchuk (“VO Svoboda”) – 40,63%. Standing Committee on Municipal Economy and Environment had 33 meetings in 2011. The committee consists of 6 deputies. The best attendance showed Artur Khorkholiuk, the head of commission, a member of “Our Ukraine" in Rivne city council. He missed 3 meetings, what is 9,1%. A deputy from all-Ukrainian Union “Fatherland” Olha Pokalchuk missed 12,1% of meetings, her colleague Mariia Konoshchuk – 21,2%, Anatolii Bobrovskyi (“VO Svoboda”) - 30,3%, Volodymyr Kovalenko (the Party of Regions) and Viktor Vivsianyk (“UDAR”) - 39,4%.

Standing Committee on Transport and Communications in 2011 had 35 meetings. The committee consists of 5 deputies. The head of Commission Sviatoslav Yevtushenko which is unaffiliated now, attended all meetings. Another unaffiliated deputy Taras Maksymenko –issed 8,6% of meetings, Oleksii Buchynskyi (“VO Svoboda”) – 17,1%, Valentyn Demchuk (all-Ukrainian Union “Fatherland”) – 26,6%, Yurii Romanenko (“All-Ukrainian Patriotic Union”) – 48,6%.

After analysis of deputies’ attendance we determined that the best visited committee is Standing Committee on Law, Justice and Human Rights (92,7%), the worst attended - Standing Committee on Economic Development (66,7%). Concerning other committees’ attendance: Standing Committee on Health Care - 89,6%, Standing Committee on Transport and Communications - 79,4%, Commission on science and education – 78,6%, Standing Committee on land distribution - 77,1%, Standing Committee on Budget - 76,3%, Standing Committee on Municipal Economy and Environment - 74,7%, Standing Committee on Regulations, deputies’ activity and ethics, local government development – 71,7%.

We can see from the diagram 1 that the smallest committees consisting of only four deputies are the best attended ones. In particular, these are Standing Committee on Human Rights and on Health Care. The commission with greater number of deputies (fro 5 to 11) have slightly worse attendance. We mention, that discipline of every deputy influences general attendance. If the committee consist of deputies which missed most of meetings, more than a half, then attendance of such commissions is considerably lower. For example, the Standing Committee on Economic Development has the worst attendance because its member Volodymyr Valiavka missed 90% of meetings.

ATTENDANCE OF THE EXECUTIVE COMMITTEE

We analyzed the attendance of executive committee from December 2010 to January 2012 since formation of new of Rivne city executive committee of 6th convocation. There were 15 meetings of executive committee during this period. Anatolii Ozimovskyi, the head the Regional department of OJSC "State Savings Bank", has the lowest attendance. He was absent on 9 meetings.

Vitalii Chuhunnikov, the head of Rivne regional office of Vitaliy Klitschko's UDAR Party is on the second place. The politician missed 7 meetings, what is 47% from the total amount. The mayor of Rivne Volodymyr Khomko is on the third place. Volodymyr Khomko, which is the head of executive committee according to the corresponding Ukrainian legislation, was present on 77% of its meetings.

The best attendance has a business representative – the director of LLC “Ovis” Volodymyr Fedorovych, which was present on all meetings of executive committee. 8 members missed one session. In particular, the secretary of Rivne council Andrii Hreshchuk; executive committee administrator Sviatoslav Vlasiuk; chief state sanitary doctor of city Yurii Romanets; representative of All-Ukrainian Union “Fatherland", the director of a private enterprise “Fakhivets-Dakh” (“Expert-Roof”) Ihor Kramarets; a representative of “Front of Changes”, deputy director of LLC “San Scherzo” Roman Denysiuk; head of budget and finance department Viktor Shulha; representative of VO “Svoboda”, urgent surgeon of the central hospital Andrii Bortnik; head of the municipal department of MIAU Petro Yezghor. Other members of the city council missed from 2 to 3 meetings.

CONCLUSIONS

After analysis of deputies’ attendance in Rivne city council and Standing committees in 2011 we determined that 4 deputies missed more than a half of plenary sessions of meetings of standing committees. Thus, a deputy from VO “Svoboda” Volodymyr Valiavka was absent on 63,16%  plenary sessions and 90% of Standing committee on economic, investment, industrial development and entrepreneurship support meetings.

A deputy from the Party of Regions Yurii Sildetskyi missed 80% of Standing Committee on Regulations, deputies’ activity and ethics, local government development meetings. His colleague in faction Oleksii Hubanov was absent on 67,86% meetings of Standing committee on science, education, culture, spiritual revival, youth, sports, relations with public associations and mass media. A deputy from All-Ukrainian Union “Fatherland” missed 57,64% meetings of Standing committee on architecture, building and land distribution.

According to Article 37 of the Law of Ukraine “On Status of Local Council deputies” one of the reasons for recall of a deputy in the City council is absence on more than a half of plenary sessions or meetings of the standing committee during one year.

Another peculiarity discovered during the analysis is that individuals which combine deputy work with work in executive bodies and local government, or in business miss more meetings than others. Volodymyr Valiavka, Oleksandr Babat and Volodymyr Hrudnytskyi, which have the lowest attendance, are engaged in business activities and Oleksii Hubanov is a civil servant. In standing committees is the same tendency. Volodymyr Valiavka, Oleksandr Babat – entrepreneurs; Oleksii Hubanov and Yurii Sidletskyi – civil servants. Yurii Romanenko, which missed 48,6% of meetings, and Andrii Ostapchuk, which missed 40,63% of meetings – are entrepreneurs.
